A bad week for my personal heroes. First, Kate McGarrigle, and now Howard Zinn.
Here is a basic obit from the AP, which is all that we find on the New York Times web edition. (Which I find odd. I mean, he was 87, and there was no canned obit ready to go?)
By now, there are tons of tributes online, so I’ll just offer one memorable interview. Here he speaks of the fact that he did horrible things in the waning days of World War II. As part of a bomber crew, he dropped napalm on a tiny French village as a kind of experiment (the flight crews were not told), but he stood up to what he had done.
AMY GOODMAN: You talk about your final bombing run, not over Japan, not over Germany, but over France?
HOWARD ZINN: Yeah. Well, we thought bombing missions were over. The war was about to come to an end. This was in April of 1945, and remember the war ended in early May 1945. This was a few weeks before the war was going to be over, and everybody knew it was going to be over, and our armies were past France into Germany, but there was a little pocket of German soldiers hanging around this little town of Royan on the Atlantic coast of France, and the Air Force decided to bomb them. 1,200 heavy bombers, and I was in one of them, flew over this little town of Royan and dropped napalm—first use of napalm in the European theater. And we didn’t know how many people were killed, how many people were terribly burned as a result of what we did. But I did it like most soldiers do, unthinkingly, mechanically, thinking we’re on the right side, they’re on the wrong side, and therefore we can do whatever we want, and it’s okay. And only afterward, only really after the war when I was reading about Hiroshima from John Hersey and reading the stories of the survivors of Hiroshima and what they went through, only then did I begin to think about the human effects of bombing. Only then did I begin to think about what it meant to human beings on the ground when bombs were dropped on them, because as a bombardier, I was flying at 30,000 feet, six miles high, couldn’t hear screams, couldn’t see blood. And this is modern warfare.
In modern warfare, soldiers fire, they drop bombs, and they have no notion, really, of what is happening to the human beings that they’re firing on. Everything is done at a distance. This enables terrible atrocities to take place. And I think reflecting back on that bombing raid, and thinking of that in Hiroshima and all of the other raids on civilian cities and the killing of huge numbers of civilians in German and Japanese cities, the killing of a hundred thousand people in Tokyo in one night of fire-bombing, all of that made me realize war, even so-called good wars against fascism like World War II, wars don’t solve any fundamental problems, and they always poison everybody on both sides. They poison the minds and souls of everybody on both sides. We are seeing that now in Iraq, where the minds of our soldiers are being poisoned by being an occupying army in a land where they are not wanted. And the results are terrible.
Zinn goes on to say that ten years later he visited the village and spoke to survivors, and relatives of those killed by the napalm bombing:
And they were very bitter about the bombing, and you know, they attributed it to all sorts of things, the desire to try out a new weapon. It’s amazing how many things are done in a war just to try out new weapons. You know, maybe the—one of the reasons for dropping the bombs on Hiroshima and Nagasaki were to see what this does to human beings. Human beings become sacrifices in the desire to develop new military technology. And I think that was one of those instances.
Glenn Greenwald notices that now the Obama Administration doesn’t distinguish between U.S. citizens and non-citizens when it comes to targeting them for assassination. From the Post (italics are Greenwald’s):
After the Sept. 11 attacks, Bush gave the CIA, and later the military, authority to kill U.S. citizens abroad if strong evidence existed that an American was involved in organizing or carrying out terrorist actions against the United States or U.S. interests, military and intelligence officials said. . . .
The Obama administration has adopted the same stance. If a U.S. citizen joins al-Qaeda, “it doesn’t really change anything from the standpoint of whether we can target them,” a senior administration official said. “They are then part of the enemy.”
I almost always agree with Greenwald but I don’t quite share the outrage over the U.S. citizen part.
I mean, really, once the President declares he has the right to order someone killed, without anything resembling due process, in a country with which we may or may not be “at war”, the citizenship of that poor misfortunate bastard (or the equally misfortunate bastards who happen to be in the vicinity when the Hellfire missiles come screaming down) seems like a quibble.
The issue is that the President and some anonymous spooks can, as a matter of everyday routine business, get together and say “Today, we are going to smoke some guy in Yemen, who may be what we call a terrorist, and anyone standing near him. And if we miss him this time, we will keep trying to kill him WITH ROCKETS until we do.” Also, if you’re a major drug lord, but NOT one of OUR major drug lords, you’re on the list, too. Got that?
According to Jane Mayer’s New Yorker article last October there are ten–ten!–collateral damage kills for every successful murder of an intended target, and that’s taking the Government’s word that the target was indeed worth targeting. (Imagine a SWAT team blowing away ten women and children in a gunfight with a suspected terrorist, and then high-fives all around because they got the guy. Actually, not that hard to imagine….)
This has not always been OK. You can go back to Ronald Reagan, that high-minded man of peace, or even further to Abraham Lincoln. Targeted assassinations, extrajudicial murders, have always been forbidden (at least officially).
A 1981 Executive Order signed by Ronald Reagan provides: “No person employed by or acting on behalf of the United States Government shall engage in, or conspire to engage in, assassination.” Before the Geneva Conventions were first enacted, Abraham Lincoln — in the middle of the Civil War — directed Francis Lieber to articulate rules of conduct for war, and those were then incorporated into General Order 100, signed by Lincoln in April, 1863. Here is part of what it provided, in Section IX, entitled “Assassinations”:
The law of war does not allow proclaiming either an individual belonging to the hostile army, or a citizen, or a subject of the hostile government, an outlaw, who may be slain without trial by any captor, any more than the modern law of peace allows such intentional outlawry; on the contrary, it abhors such outrage. The sternest retaliation should follow the murder committed in consequence of such proclamation, made by whatever authority. Civilized nations look with horror upon offers of rewards for the assassination of enemies as relapses into barbarism.
Most amusing to me was the fact that [Peter Wallsten] finally got the goods about Rahm’s famous Veal Pen tirade, when Rahm showed up at the Common Purpose meeting and lambasted the liberal interest groups because MoveOn was running radio ads against Blue Dogs. Previously it had been reported that Rahm called them “f*#king stupid,” even though the scuttlebut was that Rahm said they were “f*#king retards.” It’s a tight-lipped crowd to penetrate, and nobody wants to get zapped from the meetings for talking to the press. But Wallsten managed to get the story:
The friction was laid bare in August when Mr. Emanuel showed up at a weekly strategy session featuring liberal groups and White House aides. Some attendees said they were planning to air ads attacking conservative Democrats who were balking at Mr. Obama’s health-care overhaul.
“F—ing retarded,” Mr. Emanuel scolded the group, according to several participants. He warned them not to alienate lawmakers whose votes would be needed on health care and other top legislative items.
Jane goes on to retell Rahm’s self-mythologizing knife story, about his Blutarsky-like reciting of his enemies’ names and then shouting “dead” while stabbing a table with a steak knife, just after Clinton was elected president. Jane rightly refuses to accept the purported point of the tale, that it shows how tough a guy Rahm is.
That’s not “tough.”
“Tough” is knowing you’re going to take massive shit for standing up to powerful interests and then doing it anyway, because it’s the right thing to do — that’s what Obama told people he would do when he was running for President.
You’re not a tough guy if your first thought upon assuming the power of the Presidency is to use it to punish your enemies. You’re a cowardly, petty, small-minded thug.
Scott Horton’s The Guantánamo “Suicides”: A Camp Delta sergeant blows the whistle should by rights have shamed the nation into demanding 1. an investigation all the way up the command chain, and 2. that Obama keep his promise to close Guantanamo. But it didn’t, of course, because this is the age we live in.
US government officials may have conspired to conceal evidence that three Guantánamo Bay inmates could have been murdered during interrogations, according to a six-month investigation by American journalists.
All three may have been suffocated during questioning on the same evening and their deaths passed off as suicides by hanging, the joint investigation for Harper’s Magazine and NBC News has concluded.
The magazine also suggests the cover-up may explain why the US government is reluctant to allow the release of Shaker Aamer, the last former British resident held at Guantánamo, as he is said to have alleged that he was part-suffocated while being tortured on the same evening.
“The cover-up is amazing in its audacity, and it is continuing into the Obama administration,” said Scott Horton, the contributing editor for Harper’s who conducted the investigation.
When the three men – Salah Ahmed al-Salami, 37, a Yemeni, and two Saudis, Talal al-Zahrani, 22, and Mani Shaman al-Utaybi, 30 – died in June 2006, the camp’s commander declared that they had committed suicide and that this had been “an act of asymmetrical warfare”, rather than one of desperation.
According to an official inquiry by the US navy, whose report was heavily censored before release, each man was found in his cell, hanging from bedsheets, with their hands bound and rags stuffed down their throats.
However, Horton spoke to four camp guards who alleged that when the bodies were taken to the camp’s medical clinic they had definitely not come from their cell block, which they were guarding, and appeared to have been transfered from a “black site”, known as Camp No, within Guantánamo, operated by either the CIA or a Pentagon intelligence agency.
The men said that the following day, a senior officer assembled the guards and told them that the three men had committed suicide by stuffing rags down their throats, that the media would report that they had hanged themselves, and ordered that they must not seek to contradict those reports.
Harper’s says that when the bodies of the three men were repatriated, pathologists who conducted postmortem examinations found that each man’s larynx, hyoid bone and thyroid cartilage – which could have helped determine cause of death – had been removed and retained by US authorities.
Auden’s poem is a work of beauty and power. It has prophetic vision, but that vision is a nightmare. It is born from the horrors of World War II. The barbed wire of concentration camps and death camps brings the Homeric epoch up to date. Auden is not portraying the tragedies of the last war as such. He is warning of a world to come in which totalitarian societies dominate and the worth and dignity of the individual human being are lost. He warns those who stand by, decent though they may seemingly be, and say nothing–perhaps because political calculus or the chimera of national glory have blinded them to the greater moral imperatives against homicide, torture and the dissemination of lies in the cause of war. Auden’s admonitions here are not necessarily those of a pacifist, though he unmistakably chides Homer for his glorification of a warrior culture. Is this, he seems to ask, where the Homeric vision of the warrior-hero has led our species?
But in the shield of Achilles, described in book 18 of the Iliad, we see Homer hammer a different tableau. Two cities are depicted on this shield. In one there is happiness, marriage, art and material plenty. The city is bound by the Rule of Law and disputes are resolved in the courts. “The other city was beleaguered by two armies, which were shown in their glittering equipment.” It is filled with strife, panic and death, and every disagreement is settled by violence, with victory going to the strongest, not the most righteous. All this potential lies in humankind, Homer tells us. Neither can be entirely stilled. But as Auden warns us, we must be ever watchful in which direction our society moves, whether it follows the dark path or the brilliant promise of the shield’s golden side.
A society that tortures and kills those placed entirely in its power and passes this fact by as a matter of indifference truly is plunging into the dark side of the world which these two poets describe–one at the dawn of man’s recorded history, the other in the crucible of modernity. On the day of these deaths in 2006, the American commander in Guantánamo violated the Homeric rules of decorum by taunting the dead and afflicting their families. The deceased prisoners “have no regard for human life,” he said. But in the end we must ask to whom those words more appropriately attach–the prisoners or those who have orchestrated the tragedy at Guantánamo? Another saying of the Achaean epoch applies to this tragedy. Long associated with the story of the Minotaur on Crete, it was recalled near the end of the nineteenth century by a philosophy professor at the University of Basel who waded deeply into the history of the era. “He who does battle with monsters,” he wrote, “needs to watch out lest he in the process become a monster himself.”
Needless to say, Americans are not holding parades for the brave camp guards who risked all to come forward. Nor are we taking to the street to protest the deaths of three nobodies on Guantanamo—”they were small/And could not hope for help and no help came.” As for the Obama Administration, no help there either:
Sergeant Joe Hickman, one of those who ended his silence about the cover-up, said he did so because of the new Administration’s commitment to right the previous one’s wrongs on civil liberties and detention policy. But Justice Department officials held one or two meetings with Hickman and his colleagues and then closed the investigation without prosecution, with a DoJ official saying to Hickman that his conclusions “appeared” to be unsupported.
Edward Klein’s Qui êtes-vous, Polly Maggoo? is a film I knew by reputation, but only just this weekend got around to watching. I loved it.
It’s had some high profile screenings this past summer, at Walker Art Center in my hometown of Minneapolis and at the Metropolitan Museum in my other hometown, in conjunction with the Model as Muse: Embodying Fashion exhibition.
This film has shoehorned its way into my all-time favorites list. From the opening scene, a fashion show where the models wear sheet-metal outfits, and the imperious editor (who bears more than a passing resemblance to Diana Vreeland) pronounces that the designer has “created the Eve for the nuclear age,” it’s a satirical tour de force, a commentary on fashion, celebrity and media that hasn’t lost any of its bite.
It’s funny, sexy, stylish as a film is possible to be, and shot in that gorgeous high-contrast black and white almost-verité style you see in Godard’s Masculin/Feminin and Richard Lester’s A Hard Day’s Night, another film from an American expat. Oh, to have been one in those days!
The star, Brooklyn-born American fashion model Dorothy McGowan is pretty much just being herself and not really caring what anyone thinks of her. She’s perfectly suited for her role, as were the Beatles, who had the same attitude. (See, especially, the classic “Dead Grotty/early clue to the new direction” scene where George stumbles into a youth marketing man’s office). Jean Rochefort plays the television producer who sets out to make fun of the superficial girl, but she is tougher and smarter than he thinks, and he ends up falling in love with her and pondering his own nothingness (I know! but it’s a sixties French movie, after all). A good chunk of the film is occupied with a subplot involving a handsome prince who is smitten with Polly’s image, and the hapless spies he sends to track her down.
With her moon face, rabbit’s teeth (her own description), and huge eyes (usually featuring some extreme deployment of mascara, liner and false eyelashes), McGowan’s gorgeous, and impossible not to look at, even when she is out of makeup, in her tiny little apartment, more appropriate for a student than a cover girl.
Klein’s photography is spectacular: in the fashion scenes as you would expect, but also in many shots of the quotidian life of Parisians (he loves tight shots of crowds from belly-button level): queued up for a cafeteria, getting into heated political arguments, stewing in traffic jams. And there is this strange and wonderful animated sequence that brings to mind Terry Gilliam’s Monty Python animations.
Alas, McGowan apparently stopped modeling and acting after this film. “Every time they take my picture, there’s a little less of me left. So what will be left of me in the end? I’d like to know.”
She was a magical woman, one foot in another world, a great songwriter, performer and bohemian, and she was surrounded, as she was dying, by family and friends. My father was there. Emmylou Harris was there. We sang to her as she lay there, in fact that certainly might have made her go that little bit faster.
As we were having this jamboree, her breathing became more laboured and she made a moaning noise. One of the nurses said this could go on for four days and we had already exhausted the back catalogue! Then Kate breathed a little differently, it was like she was saying, “Hold on, I’m going to end this show” and she died. I was looking right into her face, her eyes were open, and my aunt Jane was holding her hand. It was an amazing experience.

I’m very shaken from losing my sister and closest friend, although last week we had a little spat. She loved fresh fruit and we had bought her some grapes, which I called “those little sacks of fluid”. Maybe it’s the way I said it, because she snapped at me: “Why do you always see the bad in things?” Maybe she associated it with the state of her lungs. I lost it, we had words, and I left and then apologised the next day. It was all fine again.
… Kate was one of the finest songwriters: her soul told her hands what to do. The song she wrote for Martha, which she performed at the Albert Hall, Proserpina, makes me cry. It’s amazing. For me, she’ll always be a contradiction: the widely read sophisticate who loved mixing with the high-end crowd with Rufus, and the rustic character, never happier than when riding an old bike, or cross-country skiing or knitting Scandinavian sweaters.

As I was sayin’, there’s something a little fishy about all these contrarian takes on conventional wisdom, by writers who style themselves as brave iconoclastic thinkers but really are just defenders of the status quo.
Here’s another one, on a subject dear to my heart, the merits of grass-fed (and -finished) over “conventionally raised” beef. In the ominously titled Beware the myth of grass-fed beef at Slate, Dr. James McWilliams, associate professor of history at Texas State University, scores yet another high-profile national opinion place. Previously, he had posted pieces on the New York Times‘ “Freakanomics” blog with provocative titles like “Are Farmer’s Markets that Good for Us?” Last April he snared the prime real estate of the Times opinion page with Free-range trichonosis, in which he argued that free-range pork could be more dangerous that the pork that comes from factory farms.
About that particular 0p-ed. It was published April 9. On April 14, this disclaimer appeared at the bottom of the piece:
An Op-Ed article last Friday, about pork, neglected to disclose the source of the financing for a study finding that free-range pigs were more likely than confined pigs to test positive for exposure to certain pathogens. The study was financed by the National Pork Board.
(Oops. Maybe someone on the Times‘ opinion staff might have thought to ask about that before running it in the paper of record. Or maybe they did. Nobody reads the retractions….)
At times, McWilliams shortchanges his own arguments by failing to disclose the financial or institutional backing of his sources (including various talking heads, esoteric-sounding think tanks, and scientific journals), leaving readers to comb extensive footnotes and web links to determine how the evidence stacks up.
If McWilliams’ goal has been to ruffle the feathers of alternative agriculture advocates everywhere, he has succeeded admirably. Mr. Google turns up many angry responses to his sometimes shady polemics.
This one, by Tom Laskowy, pegs McWilliams as as a willing participant in the FUDosphere (FUD standing for Fear Uncertainty Doubt), a “network of Sith-lord scientists and unrepentant PR flacks who have no compunctions about tweaking their research methodologies … to generate results both favorable to industry and confusing to those trying to understand the truth.”
The FUD-osphere includes doctors who perform industry-funded research to demonstrate the safety of new drugs (Vioxx, anyone?). It includes crackpot scientists and historians, like James McWilliams, who has an op-ed in the NYT in defense of factory-farmed pork—shown to be fiction by Marion Nestle and and Civil Eats. McWilliams has a history with this kind of thing—he authored a deeply flawed article in Slate —debunked here—accusing organic agriculture of responsibility for the presence of heavy metals in soil. Meanwhile, he has written a forthcoming book about the evils and dangers of local food. Really.
In a review of his Just Food, also in Grist, Stephanie Ogburn identifies McWilliams’ modus operandi:
Again and again, one gets the uncomfortable feeling that McWilliams creates fanatical straw men in order to make his own presentation of facts seem like a rational alternative. “The problems that I have with organic agriculture have less to do with how it is currently practiced than with the inflated claim that it’s the only alternative to today’s wasteful conventional production,” he writes. But do any serious proponents seeking more sustainable alternatives to conventional agriculture claim this?
OK. To the subject at hand, the “myth” of grass-fed beef. McWilliams’ point is not wrong. It just does not merit being treated as a sensational revelation.
McWilliams accepts that the acidic stomach of grain-fed cattle is capable of spawning up to a million times more acid-resistant E. coli than grass-fed cattle, as studies at the beginning of the decade demonstrated. However, he points out that more recent studies have shown “that grass-fed cows … become colonized with E. coli O157:H7 at rates nearly the same as grain-fed cattle.” This is not an unimportant fact (though it ignores the important context of cleanliness at slaughter–see below). But McWilliams takes it as earth-shattering, and as an opportunity to deliver a knockout blow to his favorite straw man:
The point in dredging up these studies … [is] a warning that advocacy for a trendy food choice might result in a public health hazard. Such a fear is confirmed by consulting the cooking directions provided by many purveyors of grass-fed beef. The home page for one major producer explains that “cooking ‘real food’ is not the same as cooking concocted food. … Grass-fed meats are best when raw (steak tartar), rare, or medium rare.” Given that the FDA recommends cooking ground beef to 160 degrees to guarantee safety from E. coli, this eat-it-undercooked advice could be dangerous.
Here comes the giant leap in logic: a loose claim by a purveyor of grass-fed beef “offers a disturbing lesson in how culinary wisdom becomes foodie dogma and how foodie dogma can turn into a recipe for disaster.”Ah, the foodie, “the right-on, ‘yes we can,’ ACORN-loving, public-option-supporting man or woman of the people” of Caitlin Flanagan’s fevered dreams. Wealthy, trendy, elitist, and ultimately dangerous. Honestly, I am not always nuts about the pretentiousness of foodie culture. But there is nothing monolithic about it. Certainly, not everyone opting out of industrial agriculture can be tarred with the foodie brush either. Quite simply, there is no foodie orthodoxy, or dogma.
And that is the case with regard to the dangers, or potential dangers, of eating any kind of food. I know there are risks of salmonella even with my free-range poached eggs, but I still like them a little runny. Just because I raise my own beef doesn’t mean there are no food safety issues to consider when serving it rare or bleu. I’ll take my chances. We all will.
At this point, those of us who are choosing alternatives are doing it not because we think we have hit on the final solution to the world’s food problems. Opting out is also in large part a protest, a refusal to buy into an industrial food system that is cruel, inefficient, unsustainable and in many ways toxic. So we still have to be careful regarding E. coli. Thank you. We knew that.
Facts are facts, and I’m sure Dr. McWilliams only toils in the service of the Truth, but one wonders how loud a splash an associate professor from Texas State would have made if his edgy, contrarian posturing wasn’t so reassuring to the corporations and trade associations that control industrial agriculture today.
Whether or not grass-feeding reduces the number and acidity of E. coli in the digestive tract of cattle, there is another undisputed reason that eating grass-fed beef may be safer. Cattle raised on pasture are cleaner at the time of slaughter.
E. coli contamination takes place in the slaughterhouse when manure from an animal comes in contact with meat. The less manure on an animal when it enters the slaughter house, the less likely the meat will become contaminated.
It is difficult to remove all the fecal contamination from feedlot cattle because they stand all day long in dirt and manure. In a recent article in the magazine Meat Marketing and Technology, the associate editor stated that pasture-raised animals were much easier to clean “because they come from small herds raised in relatively clean pastures.” Most U.S. cattle, he said, “are raised in far larger numbers in congested and typically less sanitary feed lots.” (“The Future of Food Safety,” by Joshua Lipsky. Banish the word looting from the English language. That is the suggestion of national treasure Rebecca Solnit, in When the media is the disaster.
It incites madness and obscures realities.
“Loot,” the noun and the verb, is a word of Hindi origin meaning the spoils of war or other goods seized roughly. As historian Peter Linebaugh points out, “At one time loot was the soldier’s pay.” It entered the English language as a good deal of loot from India entered the English economy, both in soldiers’ pockets and as imperial seizures.
After years of interviewing survivors of disasters, and reading first-hand accounts and sociological studies from such disasters as the London Blitz and the Mexico City earthquake of 1985, I don’t believe in looting. Two things go on in disasters. The great majority of what happens you could call emergency requisitioning. Someone who could be you, someone in the kind of desperate circumstances I outlined above, takes necessary supplies to sustain human life in the absence of any alternative. Not only would I not call that looting, I wouldn’t even call that theft.
Necessity is a defense for breaking the law in the United States and other countries, though it’s usually applied more to, say, confiscating the car keys of a drunk driver than feeding hungry children. Taking things you don’t need is theft under any circumstances. It is, says the disaster sociologist Enrico Quarantelli, who has been studying the subject for more than half a century, vanishingly rare in most disasters.
Personal gain is the last thing most people are thinking about in the aftermath of a disaster. In that phase, the survivors are almost invariably more altruistic and less attached to their own property, less concerned with the long-term questions of acquisition, status, wealth, and security, than just about anyone not in such situations imagines possible. (The best accounts from Haiti of how people with next to nothing have patiently tried to share the little they have and support those in even worse shape than them only emphasize this disaster reality.) Crime often drops in the wake of a disaster.
The media are another matter. They tend to arrive obsessed with property (and the headlines that assaults on property can make). Media outlets often call everything looting and thereby incite hostility toward the sufferers as well as a hysterical overreaction on the part of the armed authorities. Or sometimes the journalists on the ground do a good job and the editors back in their safe offices cook up the crazy photo captions and the wrongheaded interpretations and emphases.

I don’t KNOW the real story behind these pictures, but I suspect the copy editor in Los Angeles didn’t know either when he or she declared that these were cases of looting.
I look at the face of both of these desperate people, especially the one carrying a bag of evaporated milk (!) and wonder how anyone can judge them. Solnit recommends a simple solution: put yourself in their shoes.
Imagine, reader, that your city is shattered by a disaster. Your home no longer exists, and you spent what cash was in your pockets days ago. Your credit cards are meaningless because there is no longer any power to run credit-card charges. Actually, there are no longer any storekeepers, any banks, any commerce, or much of anything to buy. The economy has ceased to exist.
By day three, you’re pretty hungry and the water you grabbed on your way out of your house is gone. The thirst is far worse than the hunger. You can go for many days without food, but not water. And in the improvised encampment you settle in, there is an old man near you who seems on the edge of death. He no longer responds when you try to reassure him that this ordeal will surely end. Toddlers are now crying constantly, and their mothers infinitely stressed and distressed.
So you go out to see if any relief organization has finally arrived to distribute anything, only to realize that there are a million others like you stranded with nothing, and there isn’t likely to be anywhere near enough aid anytime soon. The guy with the corner store has already given away all his goods to the neighbors. That supply’s long gone by now. No wonder, when you see the chain pharmacy with the shattered windows or the supermarket, you don’t think twice before grabbing a box of PowerBars and a few gallons of water that might keep you alive and help you save a few lives as well.
The old man might not die, the babies might stop their squalling, and the mothers might lose that look on their faces. Other people are calmly wandering in and helping themselves, too. Maybe they’re people like you, and that gallon of milk the fellow near you has taken is going to spoil soon anyway. You haven’t shoplifted since you were 14, and you have plenty of money to your name. But it doesn’t mean anything now.
If you grab that stuff are you a criminal? Should you end up lying in the dirt on your stomach with a cop tying your hands behind your back? Should you end up labeled a looter in the international media? Should you be shot down in the street, since the overreaction in disaster, almost any disaster, often includes the imposition of the death penalty without benefit of trial for suspected minor property crimes?
Or are you a rescuer? Is the survival of disaster victims more important than the preservation of everyday property relations? Is that chain pharmacy more vulnerable, more a victim, more in need of help from the National Guard than you are, or those crying kids, or the thousands still trapped in buildings and soon to die?
It’s pretty obvious what my answers to these questions are, but it isn’t obvious to the mass media. And in disaster after disaster, at least since the San Francisco earthquake of 1906, those in power, those with guns and the force of law behind them, are too often more concerned for property than human life. In an emergency, people can, and do, die from those priorities. Or they get gunned down for minor thefts or imagined thefts. The media not only endorses such outcomes, but regularly, repeatedly, helps prepare the way for, and then eggs on, such a reaction.

Let’s start with the picture of the policeman hogtying the figure whose face is so anguished: “Ignoring thousands still trapped in rubble, a policeman accosts a sufferer who took evaporated milk. No adequate food distribution exists for Haiti’s starving millions.”
And the guy with the bolt of fabric? “As with every disaster, ordinary people show extraordinary powers of improvisation, and fabrics such as these are being used to make sun shelters around Haiti.”
In spite of the fact that I’ve slapped out rather large chunks of this essay, please read it in full. Solnit is a great writer who always has a fresh, insightful and, at times, strangely optimistic perspective on some of the most difficult topics.
A divided Supreme Court on Thursday swept away decades of legislative efforts to restrict the role of corporations in election campaigns, ruling that severe restrictions on corporate spending are inconsistent with the First Amendment’s protection of political speech.
The ruling also effectively rolls back many curbs on “soft-money” campaign financing–the coy corporate practice of doling out dosh on candidates’ behalf via dummy interest-group expenditures–during the homestretch of elections that were instituted in the already weak McCain-Feingold campaign finance law. In the majority opinion, Justice Anthony Kennedy stirringly pronounced that “the censorship we confront is now vast in its reach,” neglecting of course to mention that virtually every other Western democracy has far stricter curbs on rampant private-sector electioneering while also mysteriously permitting their private citizens to express themselves just fine.
And Dahlia Lithwick’s The Pinocchio Project has the best subhed: “Watching as the Supreme Court turns a corporation into a real live boy.”
The court had to reach out far beyond any place it needed to go to strike down century-old restrictions on corporate spending in federal elections. This started off as a case about a single movie. It morphed into John Roberts’ Golden Globe night.
Funny. This is a silly case, and what the Court has wrung from it is so preposterous that you want to laugh. But no.
But you can plainly see the weariness in [dissenting Justice John Paul] Stevens[‘] eyes and hear it in his voice today as he is forced to contend with a legal fiction that has come to life today, a sort of constitutional Frankenstein moment when corporate speech becomes even more compelling than the “voices of the real people” who will be drowned out.
“A Constitutional Frankenstein moment.” It has been a pretty awful week.
